Artwork Listings and Authenticity

What kind of work can I sell on DOTDAT?

Artists may list original, physical artworks created entirely by them.

The following are not permitted:

  • AI-generated works

  • Mass-produced works

  • Derivative works, including fan art, copyrighted characters, logos, trademarks, or substantial reproduction of existing artworks

DOTDAT does not make legal determinations regarding fair use. Artists are solely responsible for determining whether any use of third-party intellectual property qualifies as fair use.

Artists are fully responsible for ensuring that all listed works are original and do not infringe any third-party intellectual property or other rights.

What information must I provide for each artwork?

Artists must provide accurate and complete information for each listing, including:

  • Title, medium, dimensions, and year

  • Price and condition

  • Whether the artwork is framed or unframed

Artists are solely responsible for the accuracy and completeness of all listing information.

Do I need to provide a Certificate of Authenticity?

Yes. All artworks sold on DOTDAT must include a signed Certificate of Authenticity (COA).

DOTDAT may provide COA templates for convenience; however, the COA represents the artist’s sole attestation. DOTDAT does not verify, authenticate, or guarantee the statements contained in any certificate and does not independently verify originality, provenance, or authorship.

Pricing, Sales, and Fees

How are prices determined?

Artists set their own prices. DOTDAT may provide general pricing guidance based on student and emerging-artist markets, but all final pricing decisions remain the artist’s responsibility.

Artists are responsible for understanding and complying with any applicable tax obligations related to pricing and sales.

What commission does DOTDAT take?

DOTDAT charges a commission on completed sales. Current commission rates are disclosed to artists prior to onboarding or listing artwork.

Commission rates may change from time to time. The Terms of Service control in the event of any inconsistency.

When is a sale considered final?

A sale is considered final subject to DOTDAT’s dispute, damage, and compliance review policies once payment has been processed, the artwork has been shipped, and delivery has been confirmed.

DOTDAT reserves the right, as permitted under its Terms of Service, Artist Agreement, and payment processor requirements, to delay, withhold, reverse, or cancel payouts in cases involving disputes, damage claims, suspected fraud, chargebacks, or policy violations.

Shipping and Fulfillment

Who is responsible for shipping the artwork?

Artists are responsible for properly packing, insuring, and shipping their artwork in accordance with DOTDAT’s published guidelines.

Failure to follow packing standards may result in the artist being held financially responsible for damage claims.

Artists are also responsible for compliance with all applicable export laws, customs requirements, and international shipping regulations.

What happens if artwork is damaged in transit?

If damage occurs during shipping, artists must cooperate with DOTDAT’s review process, including providing photographs, receipts, insurance information, and carrier documentation.

DOTDAT may facilitate communication between the artist, collector, and shipping carrier but is not liable for carrier errors, loss, or damage caused by improper packing.

Risk of loss transfers to the collector upon confirmed delivery to the shipping address provided at checkout.

Payments and Taxes

How do I get paid?

Payments are processed through DOTDAT’s third-party payment partners. Artists receive payouts via their selected payout method after delivery confirmation and any applicable holding period.

Payouts are subject to third-party payment processor rules and restrictions beyond DOTDAT’s control. Timelines may be extended due to disputes, chargebacks, fraud prevention reviews, or compliance requirements.

Am I responsible for taxes?

Yes. Artists are solely responsible for reporting and paying any applicable local, state, federal, or international taxes resulting from sales made through DOTDAT.

DOTDAT does not provide tax or legal advice and may collect or remit taxes only where legally required.

Intellectual Property, VARA, and Platform License

Artists retain all intellectual property rights, including copyright, in their work.

Nothing in DOTDAT’s policies waives or transfers an artist’s rights under the Visual Artists Rights Act (VARA), except to the limited extent necessary for platform display, resizing, or formatting without distortion.

Artists grant DOTDAT a limited, non-exclusive license to display images of their work solely for platform operation, promotion, and marketing in connection with the Platform.

Listings reported for copyright or trademark infringement may be removed and may result in account termination, including immediate termination for serious violations. DOTDAT reserves sole discretion in determining enforcement actions.

Platform Conduct and Enforcement

Can my account or listings be removed?

Yes. DOTDAT reserves the right to remove individual listings, suspend accounts, or terminate accounts at its sole discretion for:

  • Policy violations

  • Misrepresentation

  • Ineligibility

  • Intellectual property infringement

  • Fraudulent, abusive, or deceptive conduct

  • Legal or compliance concerns

Does DOTDAT insure my artwork?

No. DOTDAT does not provide insurance coverage for artworks.

Artists are strongly encouraged to obtain independent insurance for high-value works prior to shipping.

DOTDAT exists to support artists at an early stage of their careers while maintaining transparency, trust, and legal compliance across the platform.

Participation on DOTDAT constitutes agreement with DOTDAT’s Terms of Service, Artist Agreement, and related policies. Artists with questions about eligibility, intellectual property, shipping, or compliance are encouraged to contact DOTDAT before listing work.
